Welcome to Duke and Dot. These terms govern your use of dukeanddot.com and any purchase you make from us. By using this site or placing an order, you agree to them. If you don't agree, please don't use the site.

We've tried to write these in plain English. Where something is genuinely a legal term of art, we've kept it — but nothing here is meant to be a trap.

1. Who we are

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to purchase from this site. By ordering, you confirm that you are.

We currently sell and ship to addresses in the United States only.

3. Orders and acceptance

Placing an order is an offer to buy, not a completed sale. We accept your order when we send you a shipping confirmation. Until then, we may decline or cancel an order for any lawful reason — including suspected fraud, a pricing or description error, or stock we can't fulfill. If we cancel an order you've already paid for, we refund you in full.

Pricing and description errors. We try hard to get specs, prices, and images right. If an item is listed at an obviously incorrect price or with a materially incorrect description, we may cancel affected orders and refund you rather than honor the error. We'll tell you if this happens.

Product images. Photography is representative. Colors vary between screens, and small manufacturing variations in finish are normal.

4. Prices, taxes, and duties

All prices are in US dollars. Applicable sales tax is calculated at checkout based on your shipping address.

Import duties are included in the price you pay. Some of our products ship from overseas. Where that's the case, we clear customs and pay all applicable duties and fees before the item reaches you. You will not receive a separate bill from a carrier, customs broker, or delivery service. If anyone ever asks you to pay a fee to receive a Duke and Dot order, do not pay it — contact us first.

We may change prices at any time. Changes don't affect orders we've already accepted.

5. Shipping, title, and risk of loss

Delivery estimates are estimates, not guarantees. Our current stated window is [X–X business days] to US addresses.

Title and risk of loss pass to you on delivery to the address you provided. If a package is confirmed delivered but you didn't receive it, contact us — we'll work with you on it, and our Returns & Refunds policy applies.

If we can't meet our stated shipping window, we will email you with a revised estimate and give you the option to cancel for a full refund.

6. Returns and refunds

Governed by our Returns & Refunds policy, which is incorporated into these terms. In plain terms: 30 days from delivery, no restocking fees, and for most items we won't ask you to ship anything back.

7. Product use and safety

Our products are for household use with pets. Please use them as intended.

Electrical items. Our fountain contains an electric pump. Use only the power adapter supplied. Keep the adapter and cord dry and off the floor where water may pool. Do not run the pump dry — it will damage the pump and may create a hazard. Unplug before cleaning or disassembly. Do not submerge the adapter. Do not use a damaged cord or adapter; contact us for a replacement.

Supervision. Pets chew cords. Assess your own animal and place the product accordingly. Keep cords out of reach of pets that chew, and supervise initial use.

Cleaning and maintenance. Follow the included instructions. A fountain that isn't cleaned on schedule can grow biofilm regardless of filtration. Regular cleaning is your responsibility and is a condition of the pump warranty.

Not veterinary advice. Nothing on this site — including any hydration calculator, guide, blog post, or email — is veterinary advice or a diagnosis. Our products are designed to encourage drinking. They are not medical devices and are not intended to treat, prevent, or diagnose any condition. If your pet's drinking, urination, or appetite changes suddenly, contact a veterinarian. A change in water intake can indicate a serious medical problem, and no product we sell is a substitute for a vet.

Water filtration. Our filters use activated carbon and mechanical filtration to improve taste and clarity and to catch hair and debris. They are not certified to remove lead, PFAS, heavy metals, bacteria, or other regulated contaminants, and we make no such claim. If you have concerns about your tap water, filtration for those contaminants requires a certified system, not a pet fountain.

8. Warranty

The Duke and Dot Fountain pump carries a 6-month limited warranty as described in our Returns & Refunds policy.

Beyond that express warranty and any rights you have under applicable law that cannot be waived, products are provided "as is." To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states don't allow these exclusions, in which case they don't apply to you.

9. Subscriptions

We do not add subscriptions to your cart. If you ever enroll in recurring filter delivery, it will be because you deliberately chose it on a screen that shows the price, the frequency, and the total before you agree.

You can cancel any subscription at any time from your account or by emailing us, effective before the next shipment. We won't make you call anyone, and we won't route you through retention screens.

10. Marketing emails

If you give us your email, we may send you marketing messages. Every one has an unsubscribe link that works on the first click. We don't sell your email address. See our Privacy Policy.

11. Reviews and customer content

If you post a review, photo, or other content to our site or tag us on social media, you keep ownership of it. You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in our marketing, including on this site, in ads, and on social channels, with attribution to your display name or handle where practical. You can ask us to stop using your content going forward by emailing us.

By posting, you confirm the content is yours, is truthful, and reflects your actual experience.

Our commitments on reviews. We do not write, buy, or incentivize fake reviews. We do not move reviews between products. We do not suppress negative reviews. We do not condition a discount, refund, or replacement on a customer leaving a positive review or removing a negative one. If we ever run a program that gives customers a free or discounted product in exchange for an honest review, that relationship will be disclosed on the review itself.

We may remove content that is unlawful, off-topic, abusive, or clearly not from a real customer.

12. Intellectual property

The Duke and Dot name, logo, site design, photography, and written content are our property or licensed to us. You may not use them commercially without written permission. You may share our content for personal, non-commercial purposes with credit.

13. Acceptable use

Don't use this site to break the law, scrape it at scale, interfere with its operation, attempt to access accounts or systems you're not authorized to reach, or resell our products in a way that misrepresents them as your own brand.

14. Third-party services

Our store runs on Shopify, and payments are processed by third-party processors. Your use of those services is subject to their terms. We don't store your full card details.

Links to third-party sites are provided for convenience. We aren't responsible for their content or practices.

15. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to a product or to your use of this site is limited to the amount you paid for the product at issue.

We are not liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law. Some states don't allow certain limitations, in which case they don't apply to you.

16. Indemnity

You agree to indemnify us against claims arising from your misuse of a product, your violation of these terms, or content you post.

17. Governing law and disputes

These terms are governed by the laws of the State of [STATE], without regard to conflict-of-laws rules.

Let's try to sort it out first. Before filing anything, email us at hello@dukeanddot.com with a description of the problem and what you'd like us to do. Most things get resolved here, quickly.

If that doesn't work. Any dispute not resolved informally will be brought in the state or federal courts located in [COUNTY], [STATE], and you and we each consent to the jurisdiction of those courts. You always retain the right to bring a claim in small claims court instead.

We have deliberately not included a mandatory arbitration clause or a class action waiver in these terms. If you have a dispute with us, your right to go to court is intact.

Nothing here limits your right to file a complaint with a government agency.

18. Changes to these terms

We may update these terms. The version in effect when you place an order is the one that governs that order. Material changes will be reflected in the "last updated" date above.
